Notice re Interim Calendaring Procedures for Judge Jellen Cases
Pending Successor Judicial Appointment
In anticipation of Judge Jellen=s January 31, 2012, retirement, the following calendaring procedures for all cases bearing the EDJ designation will apply. These procedures may be subject to change.
Please contact Ruby Bautista, Judge Jellen=s Courtroom Deputy, at (510) 879-3529 for all hearing requests.
Judge Jellen will preside over all hearings in adversary proceedings under standard calendaring procedures through January 16, 2012. No adversary proceeding hearings will be scheduled before Judge Jellen or his successor between January 17, 2012 and March 1, 2012.
Adversary proceedings commenced after approximately November 25, 2011 will have an initial status conference scheduled no earlier than March 1, 2012.
Adversary proceeding motions that cannot be resolved prior to January 16, 2012, shall be continued to a date no earlier than March 1, 2012 or heard according to the Emergency Hearing Procedures, described below.
Relief from Stay Hearings
Judge Jellen will preside over all relief from stay hearings through January 20, 2012. The next regular relief from stay hearing date will be February 17, 2012, and hearings will continue to be set on the first and third Friday of each month thereafter.
Final relief from stay hearings will be set on a case by case basis or reassigned to another judge.
Chapter 13 Confirmation Hearings
Judge Efremsky of the Oakland Division will preside over the January 9, 2012 confirmation calendar. Judge Lafferty of the Oakland Division will preside over the February 13, 2012 confirmation calendar, unless a successor to Judge Jellen has already taken office.
Law and Motion Calendar
Judge Jellen will preside over all law and motion matters through January 12, 2012. Judge Lafferty of the Oakland Division will preside over the January 19, 2012 calendar, and Judge Efremsky of the Oakland Division will preside over the January 26, 2012 calendar.
Law and motion matters will continue to be calendared normally in February 2012.
No trials other than final relief from stay hearings will be scheduled between December 1, 2011 and March 1, 2012.
Emergency Hearing Requests
In any case or adversary proceeding, requests for emergency hearings will be considered on a case-by-case basis, and, if appropriate, heard by Judge Jellen or his successor. If Judge Jellen or his successor is not available to preside over the matter, another Bankruptcy Judge in the Oakland Division will be available to hear the matter.
