Judge Jellen’s Procedures for appearing telephonically at court hearings

Send a written request to chambers, either by mail or facsimile (510-879-3524) stating the name of the attorney or party who wishes to appear, who he/she represents, and the party=s position in the case (i.e. secured/unsecured creditor, defendant, etc.), the case information including date and time of the hearing, and the reason a telephonic appearance is necessary*. Requests should be submitted at least two court days prior to the hearing. All requests will be addressed on a case- by-case basis and chambers staff will contact the requesting party regarding approval of the request. If the request is approved, the party shall contact Court Conference at 866-582-6878, inform the representative of the approval, and coordinate the conference call with Court Conference directly. Persons appearing by telephone, and not the court, will be responsible for the payment of any charges imposed by Court Conference. Persons appearing by telephone are not permitted to use any speakerphone device at any time during the Calendar (even before their particular case is called). Any person who does so may be disconnected without notice.

* If the hearing is on a motion for relief from the automatic stay, the party wishing to appear by telephone must make a diligent attempt to resolve the motion by stipulation before submitting the request to the court. The request must include, in addition to the items mentioned above: (a) a certification that such attempt has been made, and (b) a statement whether the opposing party or parties oppose relief. Movants should not assume that the court will routinely grant requests to appear by telephone at hearings on stay relief motions.
