AMENDED ORDER RE REPORTING INCOME IN CHAPTER 13 CASES

This Amended Order replaces and supersedes the Order Re 16 Reporting Income in Chapter 13 Cases dated December 7, 2009.

(1) At least seven days prior to the first date set for the meeting of creditors required by 11 U.S.C. §341(a), each Chapter 13 debtor shall file a declaration attesting to his or her total income from employment for each of the six months preceding the date upon which the debtor filed his or her petition for relief. Such declaration shall substantially conform to the form of declaration posted on the Court's and the Chapter 13 Trustee's websites. The debtor shall attach to such declaration the payment advices or other evidence of payment required by 11 U.S.C. §521(a) (1) (B) (iv) for the sixty days prior to the petition date.

(2) A debtor may request an extension of the time to file the required declaration by filing an application for extension of time prior to the expiration of the original deadline.
(3) Failure to comply with this order may constitute grounds for dismissal of the debtor's case after notice and an opportunity for hearing.
