Effective January 1, 2023, the Northern District of California |
The Chapter 13 Model Plan (dated August 1, 2013), is currently being used in Oakland, San Francisco and San Jose. EFFECTIVE July 1, 2017, the use of the model plan will be required in ALL divisions of the Northern District.
The form order will be effective July 1, 2017, and will be required in the Oakland Division when obtaining a court order to modify the Chapter 13 Plan. This preferred form order, approved by all Chapter 13 Trustees, may also be used in the San Francisco, Santa Rosa and San Jose Divisions.
New events, event modifications, and event deactivations that affect all chapters as well as new NEF definitions that take effect in June and July 2017 are posted under the New in ECF page. Please note in particular that the court will reinstate the prior practice of noticing the Debtor’s Certification in Support of Discharge and Debtor’s Statement re Pending Proceedings through BNC in chapter 13 cases.
