Request for Comments on the Northern District's New Chapter 13 Plan

PLEASE TAKE NOTICE that the Court is requesting comments on the new Chapter 13 Plan (to be effective on 12/1/2017).  A pdf of the Chapter 13 Plan is below. Comments regarding the new Chapter 13 Plan may be emailed to the bench-bar liaison representatives Sarah Little s.little@kornfieldlaw.com and W. Kirk Moore wkmoore@bayareabk.com by October 3, 2017. Subject line of the email should be: Chapter 13 Plan Comments.  The bench-bar liaison representatives will prepare a summary of comments for the judges’ review. In addition, the actual comments will be forwarded to the judges.  Also below is a pdf of the instructions to assist in the review of the new Chapter 13 Plan.

Policy on Personal Data Identifiers

Application of Policy on Privacy of Personal Data Identifiers

In the interest of full and open access by the public to the records and the dockets of the Bankruptcy Court, absent an order on a motion to file a document under seal, to file a redacted document, to redact a document, or to restrict access to a document or an applicable exception, the Clerk’s Office will not manually or electronically seal, redact or restrict access to a document filed with the court electronically or in paper.  Consistent with Bankruptcy Rule 9037 and the Judicial Conference Policy on Privacy and Public Access to Electronic Case Files, in an electronic or paper filing made with the court that contains an individual’s social security number, taxpayer identification number, birth date, the name of an individual, other than the debtor, known to be an identified as a minor, or a financial account number, unless the court orders otherwise, a party or non-party making the filing may include only:

(1)  The last four digits of the social security number and taxpayer identification number;

(2)  The year of the individual’s birth;

(3)  The minor’s initials; and

(4)  The last for digits of the financial account number.

This policy on privacy of personal data identifiers is subject to the provisions of, inter alia, 11 U.S.C. §§ 107 and 112, Bankruptcy Rule 9037, Civil Local Rule 79-5, the district procedure for Electronically Filing Sealed and Redacted Documents, and the Interim District Procedure for Motions to Redact.

Transcription Services Solicitation

The Bankruptcy Court for the Northern District of California (the Court) is soliciting vendors to include on a publicly posted approved list of qualified transcription services providers.  Vendors interested in receiving a solicitation packet detailing the Court's requirements should send an email to the Procurement Administrator, Suzanne McBride, at suzanne_mcbride@canb.uscourts.gov.

All requests for the solicitation packet must be received no later than Friday, August 18, 2017, at 5:00 p.m. PDT.  All proposals must be received via email no later than Friday, August 25, 2017, at 5:00 p.m. PDT.

Northern District Chapter 13 Model Plan

The Chapter 13 Model Plan (dated August 1, 2013), is currently being used in Oakland, San Francisco and San Jose. EFFECTIVE July 1, 2017, the use of the model plan will be required in ALL divisions of the Northern District.

NEW Form Order Modifying Chapter 13 Plan

The form order will be effective July 1, 2017, and will be required in the Oakland Division when obtaining a court order to modify the Chapter 13 Plan.  This preferred form order, approved by all Chapter 13 Trustees, may also be used in the San Francisco, Santa Rosa and San Jose Divisions.

Recruitment to the Bench-Bar Liaison Committee

The Bench-Bar Liaison Committee (the “Committee”) is seeking members of the Bar to serve a three-year term on the Committee. There are currently seven (7) vacancies in the Committee and service will commence on July 1, 2017.

Prospective Committee members should review the requirements and selection criteria of General Order No. 15. Trustees and employees of the U.S. Trustee are eligible to apply. Applicants must commit to participate in six to eight Committee meetings each year during their membership term and to otherwise actively further the Committee’s mission. NEW General Order No. 31. Amended Order regarding Deposit and Investment of Registry Funds



Changes to procedures and fees for registry funds invested with the Court become effective December 1, 2016.

  • To accommodate a few changes in the administration of registry funds, General Order No. 31 becomes effective on December 1, 2016. As specified in GO 31 paragraph IV (E), the disputed ownership funds provision will become effective when the Court Registry Investment System (CRIS), as administered by the Administrative Office of the United States Courts (AO), begins to accept Disputed Ownership Fund (DOF) deposits.
     
  • The Judicial Conference approved changes in the fee structure for registry funds that become effective December 1, 2016.  For more information regarding the fee structure refer to General Order No. 31, paragraph III.

The new procedures enable the Court to administer the tax administration requirements established by the Internal Revenue Service for registry funds through the CRIS investment mechanism.

     Using § 506 of the Bankruptcy Code instead of § 522 to avoid judicial liens on a debtor’s home works, sort of, but reflects a dangerous lack of knowledge of elementary bankruptcy procedure. This seminar is intended to impart enough understanding of the Federal Rules of Bankruptcy Procedure so that attendees will never again make this mistake. The general risks of using improper bankruptcy procedure will also be discussed.

     Attendance at this seminar is limited to attorneys, trustees and other bankruptcy professionals. There is no charge for enrollment or materials. For reservations or further information email Cara_Porter@canb.uscourts.gov.

     This activity has been approved for Minimum Continuing Legal Education credit by the State Bar of California in the amount of 1 1/2 hours.
