In 2022, the Bankruptcy Threshold Adjustment and Technical Corrections Act temporarily reinstated increased debt limits to qualify as a debtor in a case filed under Subchapter V of Chapter 11, and under Chapter 13. These debt limit increases expired on June 21, 2024.
Effective for cases filed on or after June 22, 2024, the Subchapter V debt limit is reduced from $7,500,000 to $3,024,725.
The Chapter 13 eligibility threshold of $2,750,000 for both secured and unsecured debt will again be divided into separate limitations for unsecured and secured debts. Effective for cases filed on or after June 22, 2024, the maximum unsecured debt is an amount less than $465,275. The maximum secured debt is an amount less than $1,395,875.

The court has revised B.L.R. 5005-2 and its Electronic Case Filing Procedures (the “ECF Procedures”), paragraph 7, to allow for the electronic filing of pleadings and other documents bearing the electronic signatures of third parties, i.e., CM/ECF Registered Participants who signed, but did not file, the given document and/or the electronic signatures of third parties, such as debtors or corporate representatives who are not Registered Participants and did not file the given document.

Judge Hannah L. Blumenstiel of the United States Bankruptcy Court for the Northern District of California asked the Federal Judicial Center (FJC) to survey attorneys and trustees to obtain feedback about her judicial performance. The FJC is the research and education agency for the federal courts. The judge's decision to ask the FJC to conduct this survey is entirely voluntary and reflects Judge Blumenstiel's ongoing commitment to provide the highest level of public service possible.
During the week of July 17th, the FJC will send an email to each attorney or trustee who has had a case assigned to Judge Blumenstiel since January 1, 2019. The email will explain how to access and complete an online questionnaire.
The survey procedure is set up so responses are anonymous. Research staff at the FJC will compile the survey responses and provide Judge Blumenstiel a report, including the comments that are provided in response to the open-ended questions and tables or figures aggregating the responses to the closed-ended questions. The survey results and report are exclusively for Judge Blumenstiel's use in improving her performance.

Effective April 24, 2023, the court has adopted Guidelines for Adversary Proceedings under 11 U.S.C. § 523(a)(8) in which the United States is a Defendant. These Guidelines are intended to accommodate guidance recently promulgated by the United States Department of Justice in cooperation with the United States Department of Education. See below pdf.
Going forward, the court will expect litigants in adversary proceedings under § 523(a)(8) to comply with these Guidelines.

After 17 years on the Northern District of California bankruptcy bench, Judge Roger Efremsky is retiring, effective January 31, 2023. Given the Northern District’s relatively low weighted caseload, it is not anticipated that the Ninth Circuit will replace him in the foreseeable future. To ensure a smooth transition, effective November 1, 2022, Judge Efremsky will be removed from the Oakland and Santa Rosa divisions’ case assignment “wheels,” and no bankruptcy cases filed on or after that date will be assigned to him. All new Oakland bankruptcy cases will be assigned to Judges Novack or Lafferty, and Judge Lafferty will replace Judge Efremsky on the Santa Rosa wheel. With regard to Judge Efremsky’s Oakland cases that are pending on February 1, 2023, all cases that end in an “even” number will be assigned to Judge Novack, and all cases that end in an “odd” number will be assigned to Judge Lafferty. Pending adversary proceedings will follow the main bankruptcy case. Judge Efremsky’s Santa Rosa cases and adversary proceedings that are pending on February 1, 2023, will be assigned to Judge Lafferty.
Bankruptcy Rules 3002, 5005, 7004, and 8023 have been amended. Additionally, the Interim Rules 1007, 1020, 2009, 2012, 2015, 3010, 3011, 3014, 3016, 3017.1, 3018, 3019, and new Rule 3017.2 adopted February 19, 2020, to implement the Small Business Reorganization Act of 2019 are no longer interim and have been adopted as Federal Rules of Bankruptcy Procedure.

Amended General Order 34 makes important changes to the requirement of reporting on post-petition direct payments to class 1 (secured) creditors. 1017-2. Voluntary Dismissal of Chapter 13 Cases.
A debtor who wishes to dismiss a pending chapter 13 case that has not previously been converted shall file a “Notice of Voluntary Dismissal Pursuant to 11 U.S.C. § 1307(b)”. This Notice shall be executed by the debtor(s) under penalty of perjury and shall attest that the case to be dismissed has not previously been converted under 11 U.S.C. §§ 706, 1112, or 1208. At the same time that the debtor files this Notice, they shall submit an Order of Dismissal.

On June 21, 2021, the United States Trustee Program’s rule entitled Uniform Periodic Reports in Cases Filed Under Chapter 11 of Title 11, published at 28 C.F.R. § 58.8 (the “Final Rule”) became effective. The Final Rule requires that chapter 11 debtors-in-possession and trustees, other than in small business and subchapter V cases, file monthly operating reports and post-confirmation reports using streamlined, data-embedded, uniform forms in every judicial district where the U.S. Trustee Program operates.
The United States Trustee Program has posted on its website updated versions of the UST Form 11-MOR, Monthly Operating Reports (“MOR”) and UST Form 11-PCR, Post-confirmation Reports (“PCR”), that should be used for all reports filed after that date. Designed to improve the overall user experience, the updates will streamline the process of embedding data on the forms by using standard PDF bar-code technology. The updates do not impact the information required to be reported on the MORs and PCRs.

On April 6, 2020, the Judicial Council of California adopted Emergency Rules intended to address issues relating to the COVID-19 pandemic. These Emergency Rules took effect on April 6, 2020 and some of them pertain to unlawful detainer actions and judicial foreclosure actions. The United States Bankruptcy Court for the Northern District of California has posted the Emergency Rules here for informational purposes only. All parties and counsel should understand that the Judicial Council’s Emergency Rules neither govern nor restrict the power of Bankruptcy Judges to decide matters based upon the provisions of the Bankruptcy Code and Rules, nor do they provide a doctrinal basis to enlarge a Bankruptcy Judge’s powers to decide matters before them.

The Administrative Office of the United States Courts has provided notice of a national breach of the CM/ECF system and has called upon courts to implement new security procedures to protect Highly Sensitive Documents. Given the limited number and nature of documents that are filed under seal by the bankruptcy court, the court construes this request to apply to all motions to seal documents filed in this court. The bankruptcy court is working to update its motion to seal protocols, and is awaiting further guidance and direction from the Administrative Office of the Courts on this matter.
In the interim, the bankruptcy court is revising its “Electronically Filing Sealed and Redacted Documents” guideline (the “Guideline”) as follows:
Step 2 under the “CM/ECF Filing Sequence For Sealed Documents” is stricken, and the moving party shall not electronically file the document(s) at issue. Instead, the moving party shall contact and inform chambers that it is filing a motion to seal a document. After notifying chambers, the moving party shall place the document(s) in question into an envelope that identifies on its cover the bankruptcy case/adversary proceeding caption and states in bold, upper case language that it contains “PROPOSED DOCUMENT(S) TO BE FILED UNDER SEAL.” The moving party shall securely seal the envelope and cause the envelope to be delivered and deposited into the court’s drop-box located in the San Francisco or San Jose courthouse. The court shall physically secure the document(s) in question.
Paragraph 4 of the Guideline shall now read as follows:
A. If Motion is Granted: The proposed document(s) Filed Under Seal will remain sealed and become part of the record, but will not be electronically filed. The Clerk will annotate the original docket entry as follows: PROPOSED SEALED DOCUMENT(S) APPROVED-REFER TO DOCKET ENTRY #_.
B. If Motion is Denied: The proposed document will remain in the secure possession of the court and will not be placed on the electronic docket. The Clerk will annotate the original docket entry as follows: PROPOSED SEALED DOCUMENTS DENIED-REFER TO DOCKET ENTRY #_.

This order establishes a new requirement regarding the noticing of civil hearings and trials conducted by video or teleconference. Unless otherwise ordered by the presiding judge, all notices of any motion or application filed with the court and served on any party which sets a hearing date for the motion or application must state that the hearing will not be conducted in the presiding judge’s courtroom but instead will be conducted by telephone or video, and include language as specified in Paragraph 8 in the Third Amended General Order 38.

Effective August 1, 2018, the use of a new form objection to claim will become mandatory in the San Jose and Salinas divisions. Word and .pdf versions of this form are attached. This revised form provides for a 30-day notice period, which is required by Rule 3007(a) and B.L.R. 3007-1(c). It also requires, consistent with B.L.R. 9013-1(b) and (d), that factual assertions be supported with concurrently filed declarations and that legal arguments be supported by a concurrently filed memorandum of points and authorities that cites to and discusses relevant authority. Please be advised that the court is working with a diverse ad hoc committee of attorneys and trustees to revisit the court's rules and guidelines regarding attorney compensation in Chapter 13 cases and will be addressing, among many other things, whether this new form justifies an increase in attorney fees.

Despite a government shutdown, the federal Judiciary will remain open and can continue operations for approximately three weeks, through February 9, by using court fee balances and other funds not dependent on a new appropriation.

Application of Policy on Privacy of Personal Data Identifiers
In the interest of full and open access by the public to the records and the dockets of the Bankruptcy Court, absent an order on a motion to file a document under seal, to file a redacted document, to redact a document, or to restrict access to a document or an applicable exception, the Clerk’s Office will not manually or electronically seal, redact or restrict access to a document filed with the court electronically or in paper. Consistent with Bankruptcy Rule 9037 and the Judicial Conference Policy on Privacy and Public Access to Electronic Case Files, in an electronic or paper filing made with the court that contains an individual’s social security number, taxpayer identification number, birth date, the name of an individual, other than the debtor, known to be an identified as a minor, or a financial account number, unless the court orders otherwise, a party or non-party making the filing may include only:
(1) The last four digits of the social security number and taxpayer identification number;
(2) The year of the individual’s birth;
(3) The minor’s initials; and
(4) The last for digits of the financial account number.
This policy on privacy of personal data identifiers is subject to the provisions of, inter alia, 11 U.S.C. §§ 107 and 112, Bankruptcy Rule 9037, Civil Local Rule 79-5, the district procedure for Electronically Filing Sealed and Redacted Documents, and the Interim District Procedure for Motions to Redact.

The Bankruptcy Court for the Northern District of California (the Court) is soliciting vendors to include on a publicly posted approved list of qualified transcription services providers. The Chapter 13 Model Plan (dated August 1, 2013), is currently being used in Oakland, San Francisco and San Jose. EFFECTIVE July 1, 2017, the use of the model plan will be required in ALL divisions of the Northern District.
The form order will be effective July 1, 2017, and will be required in the Oakland Division when obtaining a court order to modify the Chapter 13 Plan. This preferred form order, approved by all Chapter 13 Trustees, may also be used in the San Francisco, Santa Rosa and San Jose Divisions.

Using § 506 of the Bankruptcy Code instead of § 522 to avoid judicial liens on a debtor’s home works, sort of, but reflects a dangerous lack of knowledge of elementary bankruptcy procedure. This seminar is intended to impart enough understanding of the Federal Rules of Bankruptcy Procedure so that attendees will never again make this mistake. The general risks of using improper bankruptcy procedure will also be discussed.

survey for Bankruptcy Judge William J. Lafferty
Judge William J. Lafferty of the United States Bankruptcy Court for the Northern District of California asked the Federal Judicial Center (FJC) to survey members of the Bar to assess his level of performance. The judge’s decision to ask the FJC to conduct this survey is entirely voluntary and is part of Judge Lafferty's ongoing commitment to provide the highest level of public service possible. The FJC, which is the research and education organization for the federal courts, is located in Washington, D.C. The FJC has been conducting similar surveys for judges for several years.
During the week of June 13, the FJC will send an email to each attorney who has had a case or proceeding assigned to Judge Lafferty during approximately the past three years. The email will explain how to access and complete an online questionnaire.
Research staff at the FJC will compile and analyze completed questionnaires, and will provide Judge Lafferty a report, including a statistical summary and a compilation of the comments that are received. FJC staff will not provide the judge with the identity of the people who responded, if that information becomes known to them. The results are exclusively for Judge Lafferty’s use in improving his performance during the remainder of his term; they will not be provided to anyone other than the judge and they will not be used in the reappointment process.
Judge Lafferty currently serves on the FJC Committee on Bankruptcy Judge Education. FJC staff who work with the committee are in a different division of the FJC and are not involved in this survey. The results will not be shared with them and will not affect Judge Lafferty’s standing on the committee.
